Our appellate attorneys have significant experience handling appeals and arguing before the Texas Courts of Appeal and the Supreme Court of Texas.  Additionally, Carter Arnett’s appellate attorneys are admitted to practice before numerous United States Courts of Appeal and the United States Supreme Court.

Our appellate practice includes among its ranks an attorney who is Board Certified by the Texas Board of Legal Specialization in Civil Appellate Law with over twenty years of experience representing clients on appeal. Our attorneys are often called upon to provide guidance in cases long before a judgment becomes final, representing clients in mandamus proceedings and interlocutory appeals, preserving error during pretrial and trial proceedings, and preparing post-verdict motions.

Representative matters include:

  • Represented surgical facilities company before the Texas Supreme Court, successfully defeating a Texas constitutional challenge to operation of limitations in a catastrophic injury/incapacitated plaintiff case – unanimous final decision for client
  • Represented the municipality and the Chief of Police of a local police department in an appeal before the U.S. Court of Appeals for the Fifth Circuit that affirmed the trial court’s award of summary judgment
  • Represented public hospital district officials on an interlocutory appeal from an adverse ruling impacting their qualified immunity to suit, reversing the district judge’s denial of a motion to dismiss and rendering judgment in their favor
  • Successfully resolved an action brought under the Texas Whistleblower Act following mandamus proceedings before the Dallas Court of Appeals
